Vives Pons & Asociados, solicitors based in Denia (Costa Blanca), can provide a comprehensive service with up-to-date legal and tax advice before and during the entire process of buying or selling a property in Spain.

In connection with property transactions we will:

  • Advise you on your liability to pay taxes and other expenses.
  • Verify the status of the current ownership with the Land Registry and confirm that it is free from debts and other charges.
  • Check that the property has all the necessary licenses and/or planning permission.
  • Advise you regarding ‘declared values’.
  • Draft a sales contract or approve contracts provided by the other party.
  • Help with the transfer of funds to Spain.
  • Accompany you on completion of the purchase; the signing of the title deed (escritura) in the presence of a Spanish Notary.
  • Arrange for payment of taxes; registration and notary fees.
  • Register the property with the Land Registry.
  • When received back from the Land Registry, we will check that title deed is correct and either send it to you or file it safely for you.
  • Represent your interests throughout the transaction by liaising with: estate agents, developers, other lawyers, the Registry, the Notary and any other interested parties.
  • Provide fiscal representation throughout the whole process.

The legal fees are 1% for the value of the property + vat ( or minimum 1.500 euros+ vat) .
The amount is agreed on in advance at larger purchases.
